There are many reasons why a suit might be lost or dismissed. If your case was dismissed following a trial or a hearing on a preliminary motion, it may be that your attorney did everything correctly, but that the Judge or jury simply found that your case was not legally supportable. On the other hand, it is possible that your claim was lost by your lawyer not filing suit on time or taking some other necessary action. If your lawyer did everything correctly, your lawyer is not responsible for the bad outcome, and he does not owe you anything. If, on the other hand, your claim was lost due to attorney malpractice, your attorney may be liable to you for the the value of your claim had it been handled properly. The fact that your attorney previously said that he would pay you out of his pocket may be an indication that your attorney knows that the claim was lost due to attorney error; otherwise, I cannot imagine an attorney who did everything properly making such an offer. Since it appears that you have already discussed the situation with your attorney, without resolving it, you should consult with a different attorney regarding your options, including the possibility of filing a claim or suit against your first attorney. Alternatively, you may wish to consider filing an ethical complaint with the Louisiana Attorney Disciplinary Board. (See http://www.ladb.org/how_to_file_a_complaint.asp) Good luck.
