Can I sue the tow company?

Lawsuits And Disputes 6 views 2 answers
Hello, A person who I do not know, posed as the owner of my vehicle, phoned a tow company who then towed the vehicle from my owned residence to a scrapping yard. The person sold the vehicle for its scrap metal value. They then paid the tow company $100 dollars for the tow. The person had no proof of ownership. I do not believe the tow driver asked for any legal documents or even her identification. The tow company advises that they are not responsible. Please Help!

You need to see a local attorney to deal with this. Typically a vehicle title would have had to be presented and signed in order to sell the vehicle to the salvage yard. If the tow company did not follow local law regarding verifying ownership, it would be liable for its negligence. You need to find out exactly what was requited in your state. You also need to be wary of deadlines for filing suit.

The poser has absolute liability. The tow driver and scrap company have liability also for negligence if they failed to require proof of ownership. However, if they they bought your car for scrap as bona fide purchasers in good faith for value, meaning they too were deceived by the person posing as the owner, they may reduce their liability, but not likely becasue their failure to require proof of ownership undercuts the good faith requirement.
