Do I have basis for a case?

It had been about 7500 miles since the last oil change on our care. As far as we were aware there was nothing wrong with the car before we took it in for an oil change at a quick lube type of place. About a mile after driving away from the place, it suddenly developed a rod knock, which means the engine is toast. We checked this diagnosis with a local mechanic. The tech said that he HAD heard a noise when we pulled in, but it stopped so he didn't think anything of it. This was stated after the fact. There are no notations on the work order that he heard a noise or that the oil was low or especially thick, or that there was anything wrong. Do I have a case for either negligence, or possibly causing the damage?

More facts and information are required in order to determine if there was negligence on the part of the owner or the service company, or if the engine failure was due to misuse or the mileage on the engine.

I need more facts and information. The Developement may be a result of negligence, or engine failure.

Facts and circumstances like this require much analysis. For example you said the oil change was overdue and had not been done by 7500 miles. Was this failure on your part the cause of the issue? You mentioned you took the car to a oil change place, did they have a duty (legal term in negligence claim) to inspect your car? Did you ask them to inspect your car? Does this oil change place do other types of diagnostic work beyond fluids? Without further details it is difficult to say if you have a claim. Was the engine "toast" as you say even before pulling into the oil change place. Also, what would the nature of your claim be, especially if you went in for an oil change, and not an engine inspection. If they failed to use the ordinary reasonable standard of care in conducting the oil change, and if the oil change place does vehicle/engine inspections in a way that would have discovered the issue, and failed to make an adequate inspection, you might have a potential claim. Seek the advice of an attorney that handles this type of issue.
