Can a dealership change a lease contract 8 days after signing the contract? I have a signed contract.

I leased a car from a local delearship, agreed on price and took delivery. They called me 8 days later and asked for more $ down because they made a mistake in their calculations that does not effect financing but their bottom line. They said I could pay it in cash or add it to the payments, so, financing was not an issue. If I put down the additional $ they asked for I would be then putting down more $ and having a higher payment then previously agreed upon. Do I have an recourse, can I make them stick to the signed contract - keep the car and not pay them another $. Thanks

Generally speaking, the dealer cannot change the terms of contract. You should contact an attorney in your area to review the contract, negotiate with the dealership, advise you of your rights/options under the terms of the contract and inform you of any possible recourse the dealership may have in relation to their error. Until then, if you have possession of the vehicle, I would not pay additional funds or even speak with the dealership. Eric M. Rolinson, Esq. The right of the dealer to alter the terms of the agreement because of a clerical mistake may depend on the wording of the vehicle lease. If you are unsuccessful in negotiating with the dealer, you should contact an attorney in your area to review the lease and suggest options available to you. As a general rule, the dealer does not have the right to alter the contract once it is signed, unless it can prove there was a mutual mistake by both parties or that you committed some type of fraud which induced the dealer to enter into the contract inappropriately. It is difficult for a car dealer to establish that type of claim since the documents were no doubt drafted by the dealer, and they are therefore, under Florida contract rules of construction, to be construed against the drafter of the contract or document. You can be assured that if the error were in favor of the dealer, the dealer would NOT be willing to change the documents in your favor. I would recommend you have an attorney review the documents before you agree to make any changes which require more money from you or higher payments.
