If you hire a private attorney, they can go to court on your behalf and conduct the DMV hearing.
As long as u fulfill your probation terms and r on misdemeanor probation u can go to another state.
Good luck
It's been said that "timing is everything," but unfortunately the timing of your DUI and your move is terrible. You face a nightmare of bureaucratic hassles and difficulties with your driver's license in both states.
If you retain a private criminal defense attorney, that attorney can handle your DUI case (and DMV Hearing) without you being present anywhere in the state. The court (judge) will allow you to complete your court-ordered requirements in another state as well.
The PROBLEM lies with the CA DMV. IF they suspend your license based on the hearing and/or a DUI conviction they will only restore your license upon completion of a DUI Class in California. Otherwise, you'll need to complete a "1650" waiver after you move and agree to NOT drive in CA.
In my opinion, if there's anyway to delay your move for three to four months, your life will be infinitely easier.
First of all you have to go to all of your Court appearances unless you have retained an attorney to do so. You also need to make sure that once your case is resolved that you pay all your fines and complete your terms of probation. The big problem is that if you do not complete the California DUI class and you move to another State you will have potential issues with your drivers license.
You will be allowed to leave but you must make sure everything is done. There is much to do and the strongest recommendation is to call a good criminal defense attorney to help you figure this all out.
There is no statute to keep you from traveling. However, the judge may order you not to travel and if s/he does make such an order then you can't travel so be careful in what you ask for. Retain an attorney and you can move today if this is a misdemeanor. It is unlikely that you will get your California drivers license back or be allowed to drive in California without completing the California DMV/DUI classes. Those classes have to be completed in state. If you don't have a California license then you can do the classes online.
well you are going to have to plead guilty in court to take care of the case or hire an attorney to make appearances on your behalf so that the case to be properly investigated and negotiated it's one or the other. Then when you move out of state 6 months after the last court date we will be able to take care of the DMV by filling out a form 1650 and providing proof of out of state residency of course you will have to do all of the probationary terms the court orders you to do which will include an alcohol program that you we'll be able to do in your new state of residence
Here is the thing: You can absolutely satisfy all of your court probation requirements out of state. But, the DMV here in California will not lift the DUI suspension unless you finish a California state approved DUI school. The California DMV would require you to agree not to drive in California in order for you to get properly licensed in another state; please note, that the other state you will be moving to may require you to do certain things for them as part of your California DUI.
In short, what you are trying to do will likely create an administrative nightmare (DMV to DMV) for you - I would recommend doing what you need to do here in California to get your California license back in valid status before you move out of state or otherwise apply for a license in your new state.
