This is not as obvious an answer as it seems to be at first glance. Most insurance policies will not cover damage caused by a stolen car in some situations. For example, if you left your keys in the ignition with it running (no matter that you need it warm and have a medical reason), I would think most insurance carriers would deny coverage because they would argue you failed to take reasonable steps to secure your vehicle. I'd bet you there is language like that in your policy. Now, if someone steals your locked car out of your garage and hotwires it to get it started, most insurance does cover that, especially if it was reported stolen immediately. In your case, you are likely facing a very unfortunate situation. I highly recommend that you contact a lawyer who handles insurance coverage issues to handle this BEFORE you make any statements, write anything else on the Internet, or do something else to further jeopardize coverage. I know several really wonderful lawyers who handle these types of matters, although I do not, generally. I wish you luck. Stephen L. Hoffman Law Office of Stephen L. If stolen, you would not be responsible for the damages caused, unless you were somehow negligent.

Report it stolen. If you are sued, provide the information to the plaintiff's lawyer. Good luck.

Your posting is a little difficult to understand, however, you are not responsible for damages done by someone who steals your vehicle. The robber is responsible for the damages he causes, both to your vehicle and any other property. Cooperate with the police in prosecuting the individual. You also should speak with the prosecutor's office about getting a restitution order against the robber for the damage caused to your vehicle. Hopefully you have now insured your vehicle. You should not own or operate any vehicle without maintaining adequate automobile liability insurance on it at all times. You should make sure that you reported the theft of the vehicle and you should retain an attorney to assist you with processing this claim. Having experienced representation can help to protect your claims. Best of luck to you.

I wish I could be more optimistic. You are liable here because you were negligent to leave the car running AND unlocked. You could just as easily have started the car, locked it, and kept the door key with you. On your facts, you are jointly and severally liable with the person who took your car. You were also breaking the law by driving an uninsured vehicle. If you cannot afford to pay for the damage / injury caused by the person who stole your car, you will lose your license. I wish I could be more optimistic.
