Are homeowner association dues wiped out through foreclosure?

WA State - can a homeowner's association collect for dues that were owed prior to a foreclosure? This is a SFR home, not a condo. The Association never liened the property. Bank sold property this month and Association is trying to charge new owners for dues from the last couple of years. I thought any dues owing would have been wiped out through foreclosure?

I don't practice in your state, but can tell you that in Florida, it depends on the association's controlling documents. In many cases, the personal obligation for the association dues would survive a foreclosure of the house. It would then mean the association would have to file a separate lawsuit to collect. However, many associations are underwater due to the numerous foreclosures, so are going to lengths that were not customary before. You should consult a local attorney for specific advice.
