What is a defense for a following too close ticket from "accident" where there was no visible damage on scene or from insurance?

I was involved in a traffic incident at a redlight where the other driver claims I hit her. I know i did not hit her because there was still space enough where I could see distance between our bumpers, I felt no impact and there was no visible damage. I think she either hit the car in front of her or locked up her brakes too hard because she claimed she felt a bump. It was a new car (no tag yet even) and I believe the young girl was a bit hysterical that she had possibly ruined her new car. When the officer arrived on scene I claimed I didn't hit her and she claimed I did. He then proceeded to write me a ticket for following too close even though I explained that we were stopped at a redlight and that I was not following too close. She filed on my insurance but the adjuster found no damage

My answer has not changed: The fact that your insurance adjuster found no damage sounds like good evidence to me, but may not be the end of the inquiry. There's a lot going on here, so if you really want to improve your chances of winning, retain a local traffic ticket attorney for assistance.

In my experience, though I do not know the laws for following too closely in Georgia, the charge of following too closely often entails a subjective analysis by the judge. You would likely want to contest this citation, and should hire a lawyer to assist you on this case in presenting evidence at an infraction trial or to negotiate with the prosecutor on your behalf.

I would recommend you contact a local traffic attorney who can assist you in fighting the case. An attorney can present your side of the story to the Court and can also help investigate your case. For example, the attorney may want to hire someone who can determine whether any of the paint from your car rubbed off on her car, or vice versa.

There is no defense to a Following Too Closely charge. This citation is written anytime one driver rear ends another. In this case it is your word against hers, and a judge or jury must sort it out. If the other driver does not show up on your trial date the charges against you should be dismissed.
