If you are planning to file in the US, you have some potential jurisdictional issues. Normally, you have to sue someone in the locale in which they reside, i.e. you would have to bring suit in China or India. Assuming one of the multiple exceptions applies, and after jumping through many legal hurdles including proving venue and jurisdiction, you would have a US judgment which can be enforced in the US, and if the company has no assets here, you have to jump through even more hurdles to try to get legal system in the foreign country to recognize and enforce an American judgment.

Your question does not provide much detail or why it is important that you will be out of the country (which country?). You are not going to like this answer, but unless the company has a legitimate place of business and assets in the United States, you should consider whether it is a waste of time and money to pursue this. While $3000 is a lot of money - in the context of a claim against a non-national company you are probably out of luck. Depending on what is involved you may want to discuss this loss with your CPA to determine if there is a way you can claim it on your taxes. This may just come down to being an expensive lesson unfortunately.
