Can I sue my doctor for causing me to lose my job?

I had surgery over 1 month ago, my gallbladder was removed. I was ready to go back to work within a week. I took my return to work certificate for him to sign, so I could go back to work. I work at Wal-mart and if you are absent for 3 days or more you have to file for FMLA. I was told by the nurse to give him a week, because he is busy. After 2 weeks that certificate was closed. I took the new certificate to the doctor and explained that I was going to lose my job and I was going to be evicted, I hadn't worked and I have no income. I was told by the nurse that she would get him to sign this. A week later I called and was told he was too busy. I have no primary doctor or any money to pay another doctor. An agency help me keep my electric on, but I am going to be homeless soon.

Has the doctor signed your form yet? If not, go to his office and ask that he do so. Wait in the waiting room until it is done, even if you sit and wait for several hours. If you have indeed fully recovered and get the note, you can apply for unemployment. Once you get the fiorm signed, take it to Walmart's HR and see if they will now rehire you. I do not believe his failure to timely give you a return to work release is malpractice. I will recode this as a Health Care question. Good luck. Good luck.
