IF Someone does work without a contract/estimate and gives you one that you do not agree with after the fact can they sue you?

I asked an acquaintance to de-winterize my home. He gave a price of $75 and I paid him. I then wanted other work done. He stated he would start the job in "good faith" and get me an estimate right away. Three days and three requests for an estimate later (I have text messages to show my request) and one final demand later he gave me an estimate for $3900 to paint 7 rooms and put in light fixtures. I asked him to stop work and take all his things which were very minimal as I supplied all the paint and supplies necessary to do the work. He left every room in the entire house in some stage of painting, but none completed and poorly done. He even left my paint open. I had to pay $2500 to have it corrected and other work as well. Not including buying more paint. Now he is suing me. Can he win?

You may owe for the value of whatever work he did do. So, I suppose the answer to your question is 'yes', he could "win".

You probably owe him for the value of the work he has done, reduced by certain factors. You will unequivocally need a lawyer. You may have a counterclaim that sounds in violations of the Ohio Consumer Sales Protection Act depending on your acquaintance's business practices. You need to get to a lawyer as soon as possible, as you only have a limited amount of time to respond to his complaint.
