Is there any way to get money back for services not rendered if I have lost contact with the other party involved?

Business Contracts 3 views 2 answers
I paid $1250 up front for 10 training sessions with a local dog trainer. I received 3 out of the 10 sessions and the trainer is no longer answering any of my phone calls or emails. His phone lines are still running and his website and voice mail still have the name of his training business active. I have text messages and a check proving that I paid for the 10 lessons, but I do not have a written contract. If he does not respond to me am I at a complete loss? He does not have a store front for his business, he does personal training at homes, parks, etc. I have the location of my last training session still in my messages which was his then current place of residence. Would it be out of line to visit that residence to see if he is still there?

There is nothing wrong with visiting a person's home, especially if it was the place the person was doing business and he had invited you to be there before. Since you know his name and have an address, start by visiting, and then, depending on what happens, take him to small claims court.

It would not be out of line, but don't be surprised if the owner becomes upset or embarrassed and asks you to leave. Then general rules of small claims court require you to submit a written demand for payment. Pay a visit and send a letter if your visit doesn't result in payment. Give them 10 days to refund your money and then sue if they fail to comply.
