School zone speeding ticket at 10am?

Traffic Tickets 1 views 2 answers
I got a ticket for speeding at a school zone. The officer said the computer was down so he will mail the ticket to me, which he did later. According to the ticket I received, the time was 10:01am and my speed was 30 mph (10 over the limit of 20). And I remember the light for school zone was not flashing and no children around. If I fight it by myself, how is the chance of the getting it dismissed? And by the way, if I could not show up at the scheduled court date, can I request a reschedule?

Be sure to check the zone. There are three types: When children present; when flashing; and between the hours of... If the zone is controlled by time then you are probably out of luck on that issue. Whether or not the court will reschedule your hearing is up to the judge. You could fight this alone, but an experienced infraction attorney can work wonders.

I agree with Mr. Jones. In addition to the factual issue of whether you were actually breaking the law, you need to request discovery to determine wether the officer did everything he was supposed to when he cited you. Frequently, the following problems can be found within tickets: incomplete information, wrong or no court box checked, ticket not filed timely, declaration insufficient, no foundation for speed measuring device, etc. I'm always amazed at the errors I find and use to beat tickets. Courts are generally not allowed to reduce school zone tickets, or offer deferred prosecutions that would keep the ticket off of your record. You should hire a skilled traffic lawyer to help you.
