What is the law in Georgia on passing through a yellow light?

Traffic Tickets 3 views 2 answers
I went through a yellow light which turned red most likely while over my head in Statesboro, GA. It had rained earlier in the day although the actual street was very dry. When the officer pulled me over, I asked what it was for and he said I failed to stop at the light. I said I did not think I could stop safely in time and he said he could give me 2 tickets, one for running the light and another for driving too fast for conditions. I was going 40 MPH in a 45 MPH zone, knowing that it changed to a 35 MPH shortly after this particular intersection. I said "ok" and did not argue because I wasn't sure what the speed limit might change to based on "driving too fast for conditions" on a road that had been rained on (although it wasn't even wet). Is there anything I can do about this?

In the current economic climate, we find that more tickets are being written. You have an arguable case. The failure to obey a traffic control device is because the light was yellow/red. Your word versus officer. However, you could consult some local attorneys in Statesboro. Find out if you would be punished more harshly for fighting the ticket. This is a 3 point violation on your driving record for a conviction or guilty plea. The maximum punishment is 12 months in jail and $1000 fine. Good Luck!

As indicated by the previous answer, The facts you recite indicate a defendable situation. The rights you have may be waived by declining to defend, but your acceptance of the ticket or explaination as to why you were cited does not, in and of themselves, amont to an admission against your interest in such a case.
