Can I legally get out of this contract with National Fitness?

I purchased a membership at a gym in Chapel Hill, NC (contract is handled by National Fitness). We signed the contract in Jan, and in Feb moved to Mebane (about 24 miles away). I requested to cancel contract through the then-general manager of gym, who said she'd do a manager override (b/c per the contract, it must be a 30mi relocation in order to cancel). Long story short, that never happened, when I called back I was told she no longer worked for the gym anymore, and was sent to a regional manager, who sent my request to cancel to their corporate office, and they told me I had to take it up with National Fitness. After many calls to National Fitness explaining the situation, they say they there is no way I can get out of the contract, nor is there a buyout. Anything I can do legally?

The statement by the former manager probably fails as a valid contract modification, because it was a promise on her part unsupported by any consideration on your part. If you have reviewed the contract and it does not appear to offer you any options, you can have someone else review the language to see if you've overlooked some cancellation provisions. You may seek a free consult with an attorney in your area to determine whether there are any remedies for your circumstances.
