Can a judge modify point cost on a traffic ticket?

Traffic Tickets 2 views 1 answers
I passed someone and when I went to lane change back into the original lane, I failed to notice that the person I passed was not behind me all the way. As a result I knocked off their mirror and swapped a little paint. The officer who responded to the other person's call was kind enough to write me a ticket for Careless Driving instead of Reckless because of my previously spotless driving record. I am currently 22 and I am wondering if there is any way for a judge to not append the points to my license as I am going to college and cannot afford the increase in insurance rates. I would be willing to do community service or something else to avoid those points.

If you are convicted or found responsible for a moving violation, the points are assessed by the Secretary of State -- the Judge cannot do anything about that. The SoS does not 'negotiate' points. Your only option would be to plead to something other than careless which has less points (improper lane use?) but that would require either a trial or agreement from the prosecutor. I'd strongly suggest you consult with a local lawyer to help work this out! Good luck.
