Can I sue a home invader?

Recently, in the early morning hours (4:00 am) we had a man come into our house. He walked upstairs and went through several bedrooms while we were home sleeping. One of the bedrooms he went through contained out 2 year old daughter. My wife got out of bed after she thought she heard our 7 year old son sneaking around upstairs, only to be confronted with the intruder. My wife screamed for me and I wrestled with the guy to the ground while she called 911. After several minutes of actively wrestling with the intruder the police showed up and arrested him for Unarmed Burglary. Turns out he is a 19 year from our town who grew up with a silver spoon in his mouth.

It sounds like you could possibly sue him for battery, trespassing, and minor property damage, but it's hard to say without being privy to all the facts. Low damages may make it not worth pursuing. I would recommend speaking with an attorney specializing in personal injury if you want to pursue this; either pick from here, or call the Boston Bar Association or Massachusetts Bar Association lawyer referral services. If you're just wanting to punish the burglar, make sure you cooperate with the DA's office and police in the investigation, and take any chance to appear and give a statement to the court.

Yes, you can definitely sue him if you'd like.

It sounds more like a criminal than a civil case, but if one of you suffered severe (and I emphasize sever) emotional distress, and if he (and not his parents) has significant assets or income, a suit might make sense.
