Contesting a texting while driving ticket?

Traffic Tickets 7 views 2 answers
Hello, I had been caught recently of "texting while driving" when I had actually not been doing the stated citation. I was switching music on Pandora app on a phone since I preferred using it as a music source rather than a radio. Unfortunately as I had no headphones with me at the time I had to result to using my hands. Fast forward to the incident. I ended up getting caught right after the stop light ahd turn green (at this point I already had returned the phone to the cupholder where it was originally placed), and was proceeded to be given a citation. The citation states that I appeared to be texting, when infact I was not. I have gathered the required documents to help my case (Call records, and Text/Web records), would there anything else be needed to at least contest the ticket?

Sounds like you have done your home work. You will need to plead not guilty and set the case for trial. Make sure you are professional in court and have copies of the records for both the court, and the City Attorney's office.

I would suggest that you need an attorney's representation if you are in the Henderson court. There are a number of attorneys that routinely do traffic matters and who know the Judges in your jurisdiction and that can help you achieve a just outcome.
