In regards to document service. We served a married party, by overnight first class mail. They refused it. We then served
their attorney, we have been involved with the party and the attorney before in the same court- which is 250 miles from their home area, the attorney did send the green card back. He has filed for a summary disposition and on his brief, the letter head is from his law office and the headings says that he is the attorney for the 2 persons ( married couple), the brief has our name the case number and all appears very correct. We do believe that we can beat the summary disposition, my question is do we have to have someone personally serve the party, or is the information that I have told you enough to leave absolutely no loopholes for the Defendants, at the end of the Summary Dispositions- to say that they were not properly served.
